What is BPC/Loas? Find out more about the benefit

The Continuous Payment Benefit (BPC/Loas) has been taking a long time for people who are entitled to the aid, and the medical evaluation and the presence of people to receive their benefit are what take the most part in this time. Unfortunately, to get it, people have been waiting, on average, 11 months. Disability retirement takes a little less time: almost 7 months. Next, find out more about the rules for getting the money.

Firstly, good news is that the National Institute of Social Security (INSS) seeks to reduce waiting times — which is a problem for people with disabilities and those who depend on sickness benefits, who are looking to receive their benefits. benefits. Therefore, people who receive benefits need to know more about strikes among doctors and experts who work for the agency.

Furthermore, the number of requests for assistance is likely to increase. According to servers, the jump is four times greater, as the number of requests went from 254,023 in July 2019 to 964,560 in March 2022. Therefore, a solution to this is to find out more about your BPC/Loas, which is guaranteed in the Organic Social Assistance Law (Loas).

What are the deadlines for receiving benefits?

The Federal Public Ministry, Public Defender's Office and INSS reached an agreement in 2021 to ease the wait for people who need aid. Therefore, the agencies set deadlines between one and three months to receive them. However, if there is any violation of these time rules, the INSS is obliged to pay the interest and monetary correction.

In this way, the federal government sets the maximum waiting time, which must be 90 days, and it is prohibited to extend beyond this time. But, if there is urgency, the benefits have a shorter period to be paid. Therefore, you can check a list with some limits for receiving them:

Benefit New Deadline
Retirements (without Disability Retirement)90 days
Disability Benefits (Sickness Benefit and Disability Retirement)45 days
Accident Assistance60 days
Death Pension60 days
Prison Aid60 days
Maternity pay30 days
Assistance Benefit (BPC/LOAS)90 days
Federal Public Ministry, Public Defender's Office and INSS define new deadlines for granting aid

In this way, the new deadline rules are already improving the problem of queues, as there has been a drop in the number of people waiting for their simple benefit: in January, there were 1.76 million and, in March of this year, 1.69 million of people.

Finally, what makes the difference in the time it takes to wait for your benefits is the queue of retirees, the elderly who earn BPC and those who earn maternity pay, for example. But cases involving sickness benefit, disability retirement and BPC for people with disabilities tend to be slower. The same condition occurs with people who were in the public service, but who were also in the private sector or, even, for people who have their pensions linked to states and municipalities.

BPC: the expertise of the federal medical service

Using the PrevFone telephone number 0800 78 0191, you can schedule your medical examination to find out if it is possible to receive your sickness benefit. Firstly, relying on expertise helps to prove sequelae and comorbidities that affect common day-to-day activities.

Furthermore, aid may be increased depending on the situation. Because of this, if the person needs someone's help all the time and, if this is certified by a medical expert report, the value of the pension for invalidity will increase by 25%, for example.

Furthermore, to receive aid such as BPC/Loas, people must have the assessment document with their identity and other items. That is why, in general, there are some that cannot be left out in the medical expert report, such as the International Classification of Diseases (ICD) and the time in which the person will be away from work (whether it will be a leave of absence for some time or permanently).

Combating fraud in the INSS

Action against crimes and irregularities in INSS is increasing, since in three months, from December 2021 to March this year, there were 17 thousand cases with attempts to circumvent the rules to win BPC/Loas and other aid. In addition to this situation, the average number of completed fraud cases was below 15 thousand in the same period.

That's why the Federal Police (PF) has been carrying out investigations in all states to find the criminals. In relation to this, the General Coordination of Social Security and Labor Intelligence (CGINT) counts 42 operations carried out in total in 2021 to stop crimes. Thus, 114 internal investigations were carried out to deal with crimes with benefits.

Furthermore, half of the crimes investigated involve false documents. Therefore, people need to be alert to offers with 'almost zero' interest rates. That way, authorities recommend attention, as warned by the Secretary of Procon of João Pessoa, Rougger Guerra:

“If the consumer really needs extra money, the safest thing to do is to look for the bank where they have their account and carefully evaluate the entire transaction contract.”

One valid tip To avoid the risk, do not disclose any of your identification to strangers, or even false employees. If the person is robbed, they must file a police report and then register with SPC/Serasa. Also, requesting payment or depositing into an account for a loan are scam tactics.
